Terms and Conditions

§ 1 Scope of Application
These Terms and Conditions apply to all agreements between GRVITY GmbH, Schauenburgerstr. 116, 24118 Kiel, Germany (hereinafter "Provider") and users (hereinafter "Customer") of the SpeakToMyCRM service. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
§ 2 Service Description
SpeakToMyCRM is an AI-powered SaaS service that enables users to create and update data in their HubSpot CRM via voice messages through Telegram and WhatsApp. This includes creating and editing contacts, deals, notes and tasks. Speech recognition is performed by European AI services (Mistral AI, Paris). The Provider owes the provision of the platform, not a specific business outcome.
§ 3 Conclusion of Contract and Account Creation
The contract is concluded by registering an account on the dashboard at speaktomycrm.ai. By registering, the Customer accepts these Terms and the Privacy Policy. Each account is assigned to a tenant (organization). The account creator automatically becomes the Owner/Admin of the tenant.
§ 4 Prices, Payment and Billing
Current prices are shown on the pricing page at speaktomycrm.ai. Billing is seat-based (per team member) and is processed monthly or annually in advance via the payment provider Stripe. Invoices are provided digitally via Stripe. The Account Owner is responsible for payment. All prices are exclusive of statutory VAT unless otherwise stated. In case of payment default, the Provider is entitled to restrict access to the service.
§ 5 Free Tier
The service offers a free tier with an allowance of 30 messages. The allowance has no time limit. After the allowance is exhausted, the user is prompted to upgrade to a paid plan. The Provider reserves the right to adjust the scope of the free tier at any time.
§ 6 Termination and Duration
Paid plans can be canceled at any time effective at the end of the current billing period. There is no minimum contract duration. Cancellation is done via the Stripe Customer Portal in the dashboard. After cancellation, access remains until the end of the paid period. The free tier can be terminated at any time by deleting the account. The Provider may terminate the contract without notice for good cause.
§ 7 Availability
The Provider strives for high availability of the service but does not guarantee a specific uptime. Scheduled maintenance will be announced in advance where possible. No Service Level Agreement (SLA) applies to the free tier. For paid plans, the Provider aims for 99.5% monthly average availability (excluding scheduled maintenance).
§ 8 Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy. The Provider processes data exclusively on EU servers (Frankfurt). Speech recognition is performed via Mistral AI (Paris, France). Audio data is deleted immediately after processing.
§ 9 Limitation of Liability
The Provider is liable without limitation for intent and gross negligence. In case of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damage. Liability is limited in amount to the amount paid by the Customer in the last 12 months, but at least €500. The above limitations do not apply to damages resulting from injury to life, body or health.
§ 10 Warranty
The Provider warrants the functionality of the service within the scope of the service description. The accuracy of AI speech recognition and processing may vary and does not constitute a guaranteed property. The Customer is advised to verify the correctness of data stored in the CRM.
§ 11 Amendment of Terms
The Provider reserves the right to amend these Terms with reasonable notice. Changes will be communicated to the Customer by email. If the Customer does not object within 30 days of receipt of the notification, the amended Terms are deemed accepted. The objection period and the consequences of silence will be specifically noted in the change notification.
§ 12 Final Provisions
The place of jurisdiction for all disputes arising from or in connection with this contract is Kiel, provided the Customer is a merchant, a legal entity under public law, or a special fund under public law. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected (severability clause). The law of the Federal Republic of Germany applies.
